Terms and Conditions

 

IT IS IMPORTANT THAT YOU CAREFULLY REVIEW THESE TERMS AND CONDITIONS BEFORE REGISTERING FOR ONE OF OUR PROGRAMS. This Agreement is between you and Bobby Ore Motorsports, LLC hereby referred to as “BOMS”. It refers to the services provided by BOMS as described on our website, bobbyoremotorsports.com and tacticaldriver.com. Enrolling in a BOMS program means you have read and accepted the terms and conditions described in this Agreement. BY ACCEPTING THESE TERMS , YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO ALL OF THE BINDING TERMS OF THIS AGREEMENT. You also acknowledge that you are at least 18 years of age.

 

 

Safety behind the wheel: BOMS and its Instructors reserve the right to stop a program at any time due to the student’s reckless and/or careless driving or unsafe conditions. Instructors may take control of the car at any point during a program if they feel that the driver is unable to complete the program safely. If a program has to be discontinued for any of these reasons, the program will be forfeited and no associated fees will be refund. 

 

Vehicles: All BOMS vehicles will be kept up to date with regular services, tire pressure and all necessary repairs. All necessary safety precautions will be taken before a student gets in a BOMS vehicle for his/her program. Should something happen to any BOMS vehicle which affects its safety or mechanical operation immediately prior to and/or during a program, BOMS will, at its sole discretion, remove the vehicle from program use. Advertised vehicles are not guaranteed available. 

 

Student’s Physical and Mental Condition: It is the responsibility of the student to notify BOMS if there are any physical, mental or other conditions that can affect the student’s ability to drive safety. The student must notify BOMS if there is any kind of medication that can affect the student’s ability to drive safely. It is similarly the student's responsibility to check if any medications affect the student’s driving abilities. Students with learning disabilities are required to disclose these conditions with BOMS prior to start of their program to contribute to the safety of both student and BOMS Instructor.

 

Behavior: Any student driving/riding in a vehicle while under the influence of alcohol or any controlled substance will immediately be removed from the class and no refunds will be given. The student must, at all times, act in a mature, respectful and appropriate manner during BOMS programs, and/or experiences. Any behavior the BOMS Instructor deems inappropriate and/or disruptive to the learning process can result in expulsion. In the case of an expulsion, no refunds will be given. There will be no exceptions. 

 

Off Site Liability: BOMS will not be held responsible for any personal injuries or property damage that students may sustain once they physically leave the BOMS training vehicle. Students accept that once the students leave the BOMS vehicle, all driving will be at their own risk and responsibility. 

 

Guarantee or Warranty: BOMS does not promise, warrant and/or guarantee that any of its students will pass his/her BOMS skills test or that they will not get into any automobile crashes while taking part in any BOMS courses and programs. BOMS also does not promise, warrant and/or guarantee that any of its students will be able to progress to the next driving instructional level as outlined in a curriculum or promoted on our website or advertising. BOMS does not warrant or guarantee your future in film or television. BOMS does not warrant or guarantee work in any industry.   To the fullest extent allowed by law, BOMS disclaims any and all express and/or implied warranties related to its program, methods, processes and/or curriculum.

 

Refunds: BOMS will not issue refunds once payment is received. BOMS, however, reserves the right to issue refunds in extraordinary circumstances on a case-by-case basis. All refund requests must be made in writing and include the specific reason(s) for the requested refund and, only if accepted and approved by BOMS management, a refund will be issued to the student on a pro-rated basis.

 

Reschedule Policy: One (1) free reschedule is allowed if more than 31 days before your scheduled school date. Any reschedules from 15-31 days before your scheduled school date will be charged a $150 fee. Rescheduling 15-10 days before your scheduled school date will be charged $500 or 50% of the initial fee, whichever is less. Rescheduling 7 days before class will be charged 50% of the initial fee. 

 

Change of Program: BOMS reserves the right, in its sole and absolute discretion, to change, alter, modify and/or terminate its program or any portion thereof at any time as it deems necessary. 

 

Release and Waiver: The students hereby release, waive, and discharge all claims and potential claims against, and covenants not to sue BOMS, its parent, subsidiaries, affiliated entities, officers, employees, agents and facilities with respect to any damages, injuries or losses of any kind to the student or any vehicle or any property damage or loss to any other party arising in connection with the student’s enrollment and participation in the BOMS curriculum, programs and training sessions and the student’s operation of any BOMS vehicles.

 

Personal Property: BOMS is not liable for anything left in BOMS vehicles or facilities by the students. Each student needs to keep track of his/her personal belongings when in a BOMS vehicle or training facility.

 

Filming: The students consent to the student being filmed during their BOMS program. The purpose of this filming is for quality control, training, media and marketing purposes. 

 

Media: In consideration of my appearance or engagement on camera, I hereby grant Bobby Ore Motorsports, LLC and those acting with its authority and permission the right to copyright, use and reuse pictures of me or materials in which I may be included, in whole, part or composite, without restriction as to changes, alterations in character or form, or reproductions thereof in any media for art, factual documentary value or any other purpose.

 

I hereby release, discharge and agree to hold harmless Bobby Ore Motorsports, LLC, its representatives or assigns and all persons acting under permission or authority from any liability by virtue of blurring, alteration, optical illusion or use in composite form that may occur during the taping, filming or photographing of my likeness or image in any subsequent processing.

 

I warrant that I am a consenting and have the right to contract in my own name. I have read the above release and am familiar with its content.
